our information gathering and dissemination practices for this

Personal Data: SpecAir
respects your privacy and does not sell any personal information
or e-mail addresses collected on its website. It also does not
share this information with any other organizations not directly
affiliated with SpecAir. Our website tracks information about
the visits to our website through various methods.
These statistics are used internally to
better provide services to the public and are not sold or provided
to other organizations.
We may use your IP address to help diagnose
problems with our server, and to administer our Web site.

Specair.com is not responsible for the privacy practices or the
content of these Web sites.
Our site uses an order form for customers
to request information, products, and services. We collect visitor's
contact information (like their e-mail address). Contact information
from the order form may be used to send information about our
company to our customers, if permission is provided. The customer's
contact information may be used to contact the visitor when necessary.
Delivery: Delivery shall
be F.O.B. Seller's facilities unless otherwise specified. Title
and all risk of loss shall pass to Buyer upon delivery.
Payment Terms: Net upon
receipt of Seller's invoice unless otherwise specified. Any claim
based on erroneous billing shall be reduced to writing by Buyer
and delivered to Seller with payment of the undisputed amount.
Buyer waives all claims to overpayment which are not reduced to
writing and delivered to Seller within thirty (30) days of such
overpayment. All claims for shortages of product must be delivered
by Buyer to Seller within five (5) days. Prices are subject to
change without notice.
Taxes: Any tax, assessment
of excise tax levied or imposed by any present or future law of
any government authority if paid by Seller as the result of the
sale and delivery of products shall be added to the price and
paid by buyer.
Seller warrants to the original Buyer only, that the product delivered
to such Buyer shall conform to the description of the products
and shall be of industry standard purity. SELLER MAKES NO OTHER
WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, IN FACT OR
BY LAW, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANT
ABILITY OF FITNESS FOR PARTICULAR PURPOSE. The only liability
of Seller for any of Seller's products not conforming to the above
shall be replacement thereof at no cost to Buyer. WARNING: SELLER
WARNS PURCHASER THAT THERE ARE HAZARDS ASSOCIATED WITH THE USE
OF THE PRODUCTS LISTED IN THIS CATALOG. Seller shall not be liable
for special, indirect or consequential damages, nor shall Seller
be liable for damages of any kind arising from use of Seller's
products whether used singly or in combination with other products
or substances. Determination of the suitability if any of Seller's
products furnished for the use contemplated by Buyer is the sole
connection therewith. Buyer assumes all risk and liability for
loss, damage, handling, or injury to persons or property of Buyer
and others arising out of use of Seller's products. Buyer specifically
acknowledges that he can obtain and install devices to sample
products delivered to determine their compliance with specifications
prior to use.
Acceptance: Conflict
of Terms: Acceptance of delivery of the products shall constitute
Purchaser's agreement to terms and conditions set forth herein.
Notwithstanding any provisions therein to the contrary, no terms
and conditions in Purchaser's order, acknowledgment form, confirmation,
or other documents issued by Purchaser with conflict with the
conditions herein, or increase Seller's obligations thereunder,
shall be binding on Seller unless specifically identified and
accepted in writing by an executive officer of Seller, and until
such acceptance is granted, Seller hereby objects to any such
terms and conditions.
Inspection & Receipt of Goods:
Buyer shall examine and check each shipment upon receipt and unless
written claim is delivered to Seller within five (5) days thereafter,
all claims with respect to said shipment or the products contained
therein shall be conclusively deemed to have been waived, and
Buyer shall be conclusively deemed to have accepted delivery of
such product by Seller as full compliance with all Seller's obligations
to Buyer with respect to such products.
Fair Labor Standards Act:
Seller represents that goods or services have been produced or
supplied in compliance with the provisions of the Fair Labor Standards
of 1938, as amended.
Return Policy: No credit
will be allowed without prior written approval of Seller.
Application of Credits:
Credit memos will be issued promptly when applicable. Current
payments for invoices may be reduced by the amount of any credit
memo. When so reducing payments, Buyer shall include the credit
memo number with the payment. No reduction in payments will be
allowed without reference to a credit memo number.
Refilling Customer Owned Cylinders:
Seller will refill customer owned cylinders subject to D.O.T.
regulation and Sellers own safety requirements. Seller suggests
that Buyer makes arrangements with Seller before Buyer ships cylinder
to Seller.
Return of Cylinders:
Before being offered for transportation, cylinders must have all
valve openings tightly closed. All dust caps or dust plugs including
cylinder caps must be in place and securely tightened. An empty
cylinder being returned by common carrier "any manner as
required when it previously contained a greater quantity of hazardous
material" (CFR49, 173, 29). The Bill of Lading should have
the proper shipping name followed by the word EMPTY. All Hazard
Class Labels must be intact.
All cylinders are returned prepaid
to the seller.
Discarding a
compressed gas cylinder is a violation of Federal Law that can
result in criminal and civil liability.
Rental Charges: All cylinders,
except Enviro-Cyl cylinders, and disposable cylinders are rental
cylinders. For all such cylinders, the then applicable rental
rate will be charged.
Lease System: A Lease
System of one (1) or three (3) years duration is available for
all customers who wish to avoid rental billing. Pricing available
upon request.
Cylinder Returns: All
cylinders (except Enviro-Cyl and disposables), caps, cylinder
valves and fittings remain property of Seller. D.O.T. regulations
do not permit the refilling of these cylinders without the prior
written permission of the Seller. All cylinders have to be returned
to the distribution station of the Seller from which they were
shipped. A charge of $8.00 (USD) will be made for each cylinder
cap damaged or not returned. If a cylinder is damaged or needs
cleaning before refilling, while in Buyer's possession, charges
will be Buyer's responsibility. Seller will charge to the Buyer
the current market value of any cylinders not returned to Seller
upon completion of the rental period.
Safety Literature: SpecAir
suggests that customers and their employees read the Material
Safety Data Sheet (MSDS) for the gas to be used prior to use of
